35 א. נגישות שירותי אינטרנט

מתוך תקנות שוויון זכויות לאנשים עם מוגבלות (התאמות נגישות לשירות), תשע"ג 2013 (הנוסח המתוקן, מאוקטובר 2017):

(א) חייב יספק התאמות נגישות בשירות אינטרנט, למעט לעניין יישומים (אפליקציות) כמשמעותם בתקנה 35ג ולמדיה מבוססת זמן לפי תקן נגישות אינטרנט בהתאם לקווים המנחים הקבועים בו, ברמה AA, ובכפוף לקבוע בסימן זה.

(ב) על אף האמור בתקנת משנה (א), יראו חייב שאינו רשות ציבורית, אשר ביצע התאמות נגישות בשירות האינטרנט המסופק על ידו ברמה A להנחיות, עד יום א' בחשוון התשע"ה (25 באוקטובר 2014), כאילו עמד בהוראות תקנה זו.

(ג)(1) מסמך שהוכן מיום ו' בחשוון התשע"ח (26 באוקטובר 2017) ואילך, כגון מסמך pdf, והועלה לאתר אינטרנט או ליישום של חייב, יהיה נגיש לפי הוראות תקן נגישות אינטרנט הדנות במסמכים וכל עוד אין תקן בעניין, התאמות הנגישות במסמך ייעשו בהתאם לאפשרויות הנגישות הסבירות שניתנו לביצוע במסגרת התוכנה שבה נוצר או נערך המסמך;

(2) על אף האמור בפסקה (1), טופס בשירותי אינטרנט שנועד למילוי במחשב של נתונים או של כל מידע אחר, ומשמש לצורך קבלת שירות, וכן מסמך שהוכן אחרי יום י"ג בחשוון התשע"ו (26 באוקטובר 2015) שבו ניתן הסבר על אודות טופס כאמור, יעמדו בדרישות תקנה זו אף אם הוכן לפני המועד הקבוע בפסקה (1).

(ד) (1) לא יראו סטייה מעמידה בהוראות סימן זה כהפרה של הוראות הנגישות, אלא אם כן נשלחה לחייב הודעה הדורשת ממנו לתקנה והחייב לא תיקנה בתוך זמן סביר אך לא יאוחר מ-60 ימים מיום קבלת ההודעה;

(2) בלי לגרוע מהוראות פסקה (1), חייב כאמור בפסקה האמורה יבצע התאמות חלופיות בהקדם האפשרי ממועד קבלת ההודעה כדי להבטיח נגישות לשירות לאדם עם מוגבלות.

תביעות לא יתאפשרו ללא שליחת הודעת דרישה לתיקון ומתן 60 יום לתיקון (עד התיקון ינתנו חלופות נגישות).
